ALGERIA (VOP TODAY NEWS) — Algerian President Abdelaziz Bouteflika announced on Tuesday evening, April 2, 2019, his resignation from the presidency before the end of his fourth term, which officially means the application of Article 102 of the Constitution.
Article 102 of the Algerian Constitution states:
” If it is impossible for the President of the Republic to exercise his duties due to a serious and chronic illness, the Constitutional Council shall meet, and after ascertaining the truth of this impediment by all appropriate means, it shall unanimously propose to the Parliament the authorization of the obstruction.
The Speaker of the Council of the Nation, exercising his powers, subject to the provisions of Article 104, shall be appointed to the Presidency of the Acting State for a maximum period of 45 days. Of the Constitution.
If the impediment continues after 45 days, the vacancy shall be announced by resignation and in accordance with the procedure provided for in the preceding two paragraphs and in accordance with the provisions of the following paragraphs of this Article.
In the case of the resignation or death of the President of the Republic, the Constitutional Council shall meet and confirm the final vacancy of the Presidency of the Republic and shall immediately inform the Assembly of the final vacancy permit to the Assembly which meets in person.
The President of the Council of the Nation shall assume the functions of the Head of State for a maximum period of ninety (90) days, during which presidential elections shall be held and the Head of State appointed in this manner shall not be eligible to run for president.
If the resignation or death of the President of the Republic coincides with the vacancy of the Presidency of the Council of the Nation for any reason, the Constitutional Council shall meet and decide on the final vacancy of the Presidency of the Republic.
In this case, the President of the Constitutional Council shall assume the functions of Head of State.
The Head of State appointed under the above conditions shall assume the function of Head of State in accordance with the conditions set out in the preceding paragraphs and in Article 104 of the Constitution and shall not be eligible to run for the Presidency of the Republic. ”
Algerian Army Chief of Staff Ahmed Kayed Saleh has called for the implementation of Article 102 of the constitution and renewed his call in a statement issued hours before Bouteflika announced his resignation.
In Algeria, since February 22, there have been widespread protests against the candidacy of Bouteflika, 82, for a fifth term in a row.
As a result of these demonstrations, President Bouteflika withdrew on March 11 from his decision to run, and before the resignation of the government and postponed the elections scheduled for April 18.
Bouteflika has also pledged to hold a national conference to draft a new constitution and reform. The conference will determine the participation of all political forces and social figures as a date for the upcoming elections.
